Equal pay — no discrimination on gender

No discrimination in wages, recruitment or conditions of employment for the same or similar work on the ground of gender, including transgender persons.

Section 3 of the Code on Wages prohibits discrimination on the ground of gender in two areas:

  • wages for the same work or work of a similar nature;
  • recruitment and conditions of employment for that work.

The ground of gender includes transgender persons. Work of a similar nature means work needing the same skill, effort, experience and responsibility, done under similar working conditions. An employer may not reduce anyone's wages to comply.
