Standing orders, misconduct and domestic enquiry

Establishments with 300 or more workers adopt standing orders based on the model. All employers should follow natural justice before punishing misconduct.

  • The Central Government's model standing orders cover:
    • classification of workers;
    • shift working and attendance;
    • leave and holidays;
    • termination;
    • misconduct and suspension;
    • grievance redressal.
  • An establishment with 300 or more workers prepares draft standing orders, or adopts the model, and has them certified.
  • Subsistence allowance: during suspension pending an enquiry, 50% of wages for the first 90 days and 75% after that, if the delay is not due to the worker (s. 31).
  • Enquiry: issue a show-cause notice or charge-sheet, hold the enquiry, record findings, and pass an order proportionate to the misconduct.

The HR desk includes warning, show-cause and termination letters with notes on these steps.
