Chapter XIII of the Code on Social Security, 2020 (ss. 139–140) replaced the Employment Exchanges (Compulsory Notification of Vacancies) Act, 1959 from 21 November 2025.
- Duty (s. 139): where the appropriate government notifies it, the employer of an establishment reports every vacancy before filling it to the career centre named in the notification. The employer need not recruit through the career centre.
- Career centres (Central Rules, 2026): Career Centre (Central) — the National Career Service portal (ncs.gov.in) — and Regional career centres. The Central Government notified digital vacancy reporting through S.O. 4629(E) (reported as 21 August 2026).
- Not covered (s. 140):
- agriculture (other than plantations) in the private sector;
- domestic service;
- employment of less than 90 days;
- non-government establishments with fewer than 20 employees, or the number notified;
- vacancies filled by promotion, by absorbing surplus staff, or through UPSC, SSC or a State PSC;
- vacancies below the monthly remuneration the government notifies;
- other classes the government notifies.
- How (Social Security (Central) Rules, 2026, rules 55–56, as summarised by secondary sources):
- vacancy report in Form XXV, one for each type of vacancy;
- at least 15 days before the last date for applications (Regional centre), or 40 days (Central centre for notified technical and scientific posts);
- result of selection to the career centre within 30 days of selection;
- yearly Employment Information Return in Form XXVI to the Regional career centre within 30 days after 31 March.
- Inspection (s. 139(4)): an executive officer may enter, inspect and copy the records, and ask questions.
Where the State Government is the appropriate government, its own Rules and notification apply. Check the Gazette text (G.S.R. 344(E), 8 May 2026, and the notifications under s. 139) before filing.
The HR desk's Compliance module records vacancies, prints the vacancy report and prepares the yearly employment information return from your employee register.
