The OSH Code and its Rules require one annual return for the calendar year, filed electronically on the Shram Suvidha portal or the State portal. The Code on Wages Rules also say that returns under that Code are filed in the OSH Code forms.
The return generally asks for:
- details of the establishment, the employer and the manager;
- the average and maximum number of workers, by men, women and transgender persons, direct and through contractors;
- inter-State migrant workers;
- days worked, hours, overtime and man-days lost;
- wages paid, deductions and fines;
- bonus paid;
- leave with wages granted;
- maternity benefit cases and amount;
- accidents and dangerous occurrences, and compensation paid;
- welfare facilities (canteen, creche, first aid, welfare officer) and safety measures;
- retrenchment, lay-off and closure;
- contractors engaged and their licences.
The HR desk's "Annual return data" collects these from your issued payrolls, leave, accident records and committees. You can check the figures and use them to file online. Check the form and due date in the final notified Rules for your State.
