Appropriate government — Centre or State?

Whether the Central or the State Government is the appropriate government decides which Rules, forms, minimum wages and inspectors apply. It depends on who runs or controls the establishment.

Under s. 2(d) of the Code on Wages and the matching definitions in the other Codes, the Central Government is the appropriate government for:

  • establishments run by or under the authority of the Central Government;
  • railways, mines, oil fields, major ports, air transport, telecommunication, banking and insurance companies;
  • Central public sector undertakings and their subsidiaries;
  • establishments of the Central Government's autonomous bodies;
  • contractors working for such establishments, as provided.

The State Government is the appropriate government for all other establishments. That covers most private factories, shops, offices and services.

Why it matters

Each government has its own:

  • Rules and forms;
  • minimum wage notifications;
  • holiday lists;
  • inspector-cum-facilitators.
