Inter-State migrant workers

Establishments with 10 or more inter-State migrant workers keep records, give a journey allowance once a year, and provide portability of ration and benefits.

Under Chapter XI of the OSH Code:

  • Who counts: a worker recruited in one State, directly or through a contractor, to work in another State, with wages up to ₹18,000 a month (or as notified).
  • Applicability: establishments with 10 or more such workers.
  • Rights:
    • equal wages;
    • an annual journey allowance (to-and-fro fare to the native place) after 180 days of service in a year;
    • portability of the public distribution system and of construction cess benefits;
    • a toll-free helpline.
  • Employer's duties:
    • keep a register of inter-State migrant workers;
    • give the worker the details of employment;
    • provide welfare facilities;
    • report fatal accidents to both States.

The HR desk marks migrant workers in the employee register and prints the migrant workers register.
