Sales promotion employees

Sales promotion employees are ‘employees’ under the Codes. They get an appointment letter, wage slips, leave and gratuity like other employees.

Sales promotion employees (medical representatives and others promoting sales) are now covered as employees under the Codes. They get:

  • an appointment letter on joining, stating designation, wages and terms;
  • wages, wage slips, bonus and gratuity under the Codes;
  • annual leave, and the hours provisions as applicable to their work;
  • PF and ESIC, if eligible.

Persons in a managerial or administrative capacity, or drawing wages above the notified limit in a supervisory capacity, may be excluded from the definition of worker for some purposes.
